Che Mokhtar & Ling, is a medium-sized establishment specializing mainly in the areas of Civil Litigation, Banking Documentations, Conveyancing, Corporate Law and Islamic Banking Law. Currently, we cater to business corporations, banks, finance and stock broking companies, developers, as well as handling individual legal disputes. We aspire to learn and grow and we are optimistic that in time to come, our fields of expertise will expand substantially.

To date, we have ten civil litigators, who are actively handling the entire process from recovery of debts, auctions, civil and foreclosure proceedings, injunctions, judicial review, and all other modes of execution proceedings including bankruptcy and winding up. We act on behalf of banks, corporations and stock broking companies, assisting them with the necessary legal actions, either by way of private, public or tender auctions, or attending Court, from Magistrates level up to the Federal level.

In this area, we deal with the sale and purchase of shares and properties, including housing development projects and sub-sales. We seek approvals from the Foreign Investment Committee (FIC) and relevant authorities, and are substantially involved in the preparation of loan documents, debentures, margin facilities, hire purchases, leasing documentations and restructuring of facilities. Our conveyancing team also manages the various transactions involved in the dealings of probate and administration, and wills and trusts proceedings.

We are involved in various aspects of the banking and financial institutions' loan documentations including Loan/Facility Agreement, Guarantee, Debenture, Deed of Assignment, Club Deal, Bridging Loan/End- financing documentations, Block Discounting, Leasing and Hire Purchase Agreement, Letter of Set-off etc.

Our team offers professional assistance and advice in joint venture agreements, legal opinions, corporate restructuring, collection of debts and defending of legal disputes and general advisory.

We are well versed with legal documentations for financial institutions based on Islamic principles and practices. Our firm is also experienced in handling the recovery of facilities granted under the Al-Bai Bithaman Ajil (BBA) scheme.

We have been engaged by many developers to be involved in housing development projects. This involves legally removing the squatters, advising them of all legal aspects of development, setting aside injunction, liaising with authorities, preparing Sale and Purchase Agreement, arranging for bridging and loan financing.
